1. Introduction
These Terms of Service ("Terms") govern your use of SparkHost.ie services operated by Everblue Digital ("we", "us", "our").
By using our services, you agree to these Terms. If you don't agree, please don't use our services.
2. Services
SparkHost.ie provides WordPress hosting and maintenance services, including:
- Web hosting on managed VPS infrastructure
- WordPress core, theme, and plugin updates
- Daily backups and restoration services
- Security monitoring and malware removal
- Technical support during Irish business hours
- Light content edits (as defined in your plan)
3. Account Registration
To use our services, you must:
- Provide accurate and complete information
- Be at least 18 years old or have legal authority to enter contracts
- Keep your account credentials secure
- Notify us immediately of any unauthorised access
You are responsible for all activity under your account.
4. Payment Terms
- Prices are quoted in Euros (€) and exclude VAT unless stated
- Irish VAT (23%) applies to all services
- Plans are billed monthly in advance on the same date each month
- Payment is due within 7 days of invoice
- We accept Direct Debit, credit/debit cards, and bank transfer
5. Cancellation & Refunds
- Cancel anytime with 30 days notice. No penalty.
- We may terminate accounts for breach of these Terms or non-payment.
- Upon cancellation, we'll assist with transferring your site to another provider.
6. Acceptable Use
You agree not to use our services for:
- Illegal activities or content
- Malware, spam, or phishing operations
- Content that infringes intellectual property rights
- Content promoting violence, hatred, or discrimination
- Cryptocurrency mining or resource-intensive automated processes
- Any activity that degrades service for other customers
We reserve the right to suspend or terminate accounts that violate these terms.
7. Your Responsibilities
You are responsible for:
- The content you publish on your website
- Maintaining valid contact information
- Responding to our requests for information (e.g., domain renewal notices)
- Ensuring you have rights to all content, images, and plugins on your site
- Complying with GDPR and other applicable laws for your website
8. Our Responsibilities
We will:
- Maintain 99.9% uptime (excluding scheduled maintenance)
- Perform daily backups and retain them per your plan
- Apply security updates in a timely manner
- Respond to support requests within our stated timeframes
- Notify you of any security incidents affecting your site
9. Limitation of Liability
To the maximum extent permitted by law:
- Our liability is limited to the fees paid for services in the 12 months preceding any claim
- We are not liable for indirect, incidental, or consequential damages
- We are not liable for data loss where backups have been provided as specified
- We are not liable for third-party actions, including hosting provider outages
Nothing in these terms limits liability for death, personal injury, or fraud.
10. Intellectual Property
- You retain ownership of your website content
- We retain ownership of our systems, tools, and processes
- Third-party plugins and themes are subject to their own licences
11. Changes to Terms
We may update these Terms from time to time. We'll notify you of significant changes via email. Continued use of our services after changes constitutes acceptance.
12. Governing Law
These Terms are governed by Irish law. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
